Lawyer Thomas Cifarelli files a lawsuit against the University of Southern California over the Tyndall sex abuse of patients matter.

LOS ANGELES, CA – Lawyer Thomas Cifarelli of The Cifarelli Law Firm filed a lawsuit against the University of Southern California and George Tyndall, M.D. in Los Angeles Superior Court on June 1, 2018, alleging among other things, sexual harassment, gender violence, sexual abuse, sexual battery, and negligence.

General Allegations as to the Parties:

Trust is the essential part of the relationship between student and school. When a student seeks health care assistance from its school, that relationship of trust is heightened where, as here, the university undertakes to provide health care services to its young students. This action involves an intersection of those sacred relationships of trust. Plaintiffs were students at the Defendant University of California ("USC") when they were sexually abused, harassed and molested by USC's Gynecologist entrusted with providing care for its female students, the serial sexual predator Defendant George Tyndall, M.D., (hereinafter "Tyndall" or "Perpetrator") Plaintiffs were sexually abused, harassed and molested by Tyndall, while they were students at Defendant USC.

While attending defendant USC, Plaintiffs required care from a gynecologist. Many of the Plaintiffs were young, still teenagers, and had never before seen a gynecologist. Defendant USC maintained a Student Health Center for the safety and well-being of their students. Defendant USC entrusted the Plaintiffs' safety and care to Defendant Tyndall. Indeed, for a significant period of the time at issue herein, Defendant Tyndall was the only gynecologist available at the Student Health Center for students to see. Thus, many female students were forced to repeatedly seek medical treatment from Tyndall, the only full-time gynecologist on staff at Defendant USC's Student Health Clinic. Tyndall used this position of trust and authority to sexually abuse Plaintiffs on multiple occasions, by engaging in acts that include but are not limited to: forcing Plaintiffs to strip naked, groping Plaintiffs' breasts, digitally penetrating Plaintiffs' vaginas, and spread open their anal crevice so that he could leer at their genitalia, for no legitimate medical purpose and for no other reason than to satisfy his own deviant sexual desires.

Defendant USC received complaints about Tyndall's inappropriate and harassing sexual behavior and comments beginning in at least 1991. Moreover, USC has publicly admitted that it received numerous complaints of Tyndall's sexually abusive and inappropriate behavior, dating back to at least the year 2000. Nonetheless, Defendant USC actively and deliberately concealed Tyndall's sexual abuse and misconduct for years, continuing to grant Tyndall unfettered sexual access to the young female students in his care, all to protect Defendant USC's reputation and financial coffers.
